Terms of Service & Participation Agreement

1. Acceptance of Terms

By creating an account, registering as a student or staff member, accessing the Customer Hub, or checking the agreement checkbox on any AnySport portal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not access our software or register for Academy sessions.

2. Scope of Software Services

AnySport operates a multi-tenant cloud software platform that enables sports academies to manage student enrollments, schedules, attendance rosters, skill evaluations, billing ledgers, point-of-sale merchandise, and regulatory e-invoice generation. AnySport provides the digital management infrastructure but does not directly deliver athletic coaching or oversee on-court physical training, which remains the sole operational responsibility of each individual Academy.

3. Sports Physical Activity & Assumption of Risk

Participation in sports training, drills, matches, and conditioning involves inherent physical risks, including but not limited to sprains, fractures, muscle strains, heat illness, and contact injuries. By enrolling in Academy programs:

• You affirm that the registered student is physically sound, medically fit, and capable of participating in strenuous athletic training.
• You assume full responsibility for all physical risks and hazards associated with participation in sports activities conducted by the Academy.
• You release AnySport SRM Technologies, AnySheetDesign, and their directors, officers, agents, and software providers from any claim or liability arising from physical injury sustained during Academy training sessions.

4. Emergency Medical Treatment Authorization

In the event of an emergency, acute injury, or illness occurring during scheduled Academy sessions where the designated parent or emergency contact cannot be immediately reached, you authorize Academy coaches, staff, and medical personnel to secure necessary medical examination, treatment, first aid, or hospital transport. Any medical expenses incurred will remain the responsibility of the student, parent, or legal guardian.

5. Billing, Tuitions, and Fee Policies

Tuition fees, program charges, and payment schedules are configured by each Academy:

• Prepaid / Postpaid Cycles: Billing schedules operate on either advance prepaid cycles or arrears postpaid cycles as determined by the Academy's billing rules.
• Due Dates & Grace Periods: Invoices are issued with a specified due date and grace period. Invoices remaining unpaid past the grace period may incur automated reminders and restrict class attendance.
• Refunds & Make-Up Tokens: Program fees are generally non-refundable unless specified otherwise by the Academy. Approved absences (e.g., medical certificates) may be credited or compensated via make-up tokens according to the Academy's absence resolution rules.
• Digital Receipts & E-Invoices: Official receipts and validated tax e-invoices issued through AnySport represent immutable accounting records compliant with statutory tax regulations.

6. Account Security & Biometric Passkeys

Users are responsible for safeguarding login credentials. The platform supports FIDO2 WebAuthn passkeys (Face ID / Touch ID / Device PIN) for secure, phishing-resistant authentication. When passkeys are enabled, biometric data is processed entirely within your local device hardware and is never transmitted to or stored on AnySport servers.

7. Code of Conduct & Fair Use

All users—including coaches, administrators, students, and parents—must maintain a respectful environment. Any abuse of platform services, automated data scraping, unauthorized account sharing, falsification of payment slips, or harassment of staff may result in immediate suspension or termination of access without refund.

8. Limitation of Liability

To the maximum extent permitted under applicable law, AnySport SRM Technologies and AnySheetDesign shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from software interruptions, data errors, or third-party communications downtime.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the substantive laws of Malaysia. Any disputes, claims, or controversies arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Malaysia.
